GENERAL RENTAL TERMS AND CONDITIONS

This agreement summarises the main provisions of the General Rental Terms and Conditions which, together with the rental agreement signed by the Customer, constitute the sole basis governing the contractual relationship between the rental company Palmanova Rent and the Customer or its Affiliates.

  1. VEHICLE ENTRUSTMENT

The rented vehicle and/or motorcycle may only be driven by a person holding a valid driving licence in category “A1”, “A2”, “A3” or “B”, as applicable. The following minimum age requirements apply:

    • “A1”: 16 years for motorcycles up to 11 kW.

    • “A2”: 18 years for motorcycles up to 35 kW.

    • “A3”: 24 years for motorcycles over 35 kW.

    • “B”: 18 years; newly qualified drivers may only drive vehicles up to 55 kW. After holding a category “B” licence for one year, drivers may drive all types of motor vehicles with up to nine seats.

    • “B”: 18 years for all types of goods vehicles up to 3.5 tonnes.

The vehicle and/or motorcycle is entrusted to the Customer on the understanding that the Customer will drive it personally. The Customer assumes all risks and liability if they allow a third party to drive the vehicle and/or motorcycle, including for the purposes of Article 116, paragraph 12, of the Italian Highway Code (Legislative Decree 285/92), concerning the entrustment of a vehicle and/or motorcycle to a person who does not hold a driving licence or is otherwise not authorised by the Rental Company.

The Customer may provide the Rental Company from which the vehicle and/or motorcycle was rented with the names of any additional drivers. These drivers may subsequently be authorised upon presentation of a valid driving licence.

Each additional authorised driver is subject to a daily surcharge equal to 50% of the rate specified for the type of vehicle and/or motorcycle rented.

For certain vehicle groups in certain locations, the Rental Company may, at its discretion, require two credit cards.

  2. RENTAL PAYMENT

Payment may be made by credit/debit card, subject to authorisation from the issuing institution, and/or in cash.

For cash payments, a security deposit must be provided by banker’s draft payable to Palmanova Rent. The amount is determined according to the type of vehicle and/or motorcycle rented.

A Customer paying by credit card authorises the Rental Company to charge the relevant account for all amounts payable under the rental relationship, including any costs necessary to recover outstanding amounts owed by the Customer to the Rental Company in connection with the rental.

  3. INSURANCE EXCESSES: THIRD-PARTY LIABILITY, COMPREHENSIVE COVER, THEFT AND FIRE

The rented vehicle and/or motorcycle is covered by motor third-party liability and comprehensive insurance in accordance with applicable law.

If any of the above events occurs, the Customer shall pay the excess specified in the rental agreement. In the event of theft and/or fire, the excess payable by the Customer is the amount stated in the rental agreement for the vehicle and/or motorcycle rented.

    (A) If the rented vehicle and/or motorcycle is damaged beyond repair in a serious accident caused by driving under the influence of alcohol and/or drugs, the excess payable by the Customer shall be equal to 100% of the current value of the rented vehicle and/or motorcycle.

For vehicles and/or motorcycles fitted with a Diablock or Blockshaft anti-theft device, if the rented vehicle and/or motorcycle is stolen and the Customer fails to return both the original door/ignition key and the key to the relevant anti-theft device, the Customer shall pay an excess equal to 100% of the vehicle’s current value.

In all cases of accident, theft or fire, whether partial or total, the Customer must file an official report with the competent authorities and submit it to the Rental Company within 12 hours of the event.

Accident damage shall not be charged to a Customer who provides a C.I.D. accident report form containing a clear, signed admission of liability by the other party.

The Customer may purchase an Additional Service that reduces or eliminates the financial liability charge for damage to the vehicle and/or motorcycle for which the Customer is responsible.

This Additional Service is subject to a charge in addition to the standard published rental rate for the vehicle and/or motorcycle. It excludes the damage described in point (A) above and does not release the Customer from the obligation to exercise due care when driving the vehicle and/or motorcycle.

Palmanova Rent reserves the right to charge the Customer a contractual penalty for damage attributable to the Customer’s responsibility.

  4. REFUELLING SERVICE

The rented vehicle and/or motorcycle must be returned with the same quantity of fuel as at collection.

For each missing litre of fuel, the Customer will be charged €2.50 per litre, plus a refuelling service fee of €30.00 excluding VAT.

  5. MILEAGE

The mileage limits and charges for additional kilometres applicable to the rented vehicle and/or motorcycle are those specified in the rental agreement.

  6. USE OF THE VEHICLE

The Customer is authorised to drive in Italy and undertakes NOT to drive the vehicle and/or motorcycle in countries other than those expressly listed on the “Green Card” supplied with the vehicle and/or motorcycle documents.

Any use prohibited by the agreement and/or by law obliges the Customer to compensate for the resulting damage, where applicable jointly and severally with any other driver. Such use invalidates any limitation of liability and exposes the Customer to the corresponding liabilities and recovery claims.

The Rental Company reserves the right to repossess the vehicle and/or motorcycle at any time and in any location if the provisions of this clause are breached.

The Customer is responsible for the lawful operation, use and routine maintenance of the vehicle and/or motorcycle.

If roadside assistance is required, for example following a breakdown or accident, the Customer may contact the Rental Company from which the vehicle and/or motorcycle was rented, using the telephone numbers specified in the rental agreement, to request instructions.

The Rental Company shall not be liable for losses or damage arising from vehicle and/or motorcycle breakdowns, failure or delay in delivery, deterioration of goods or damage of any other kind, except in cases of wilful misconduct or gross negligence by the Rental Company.

The Rental Company shall likewise not be liable for damage to items transported in or left inside the returned vehicle and/or motorcycle.

The Customer is responsible for fines and/or other charges arising from breaches of the Highway Code or other laws or regulations, tolls, parking charges and, generally, any amounts arising from driving the vehicle and/or motorcycle during the rental period, including when driven by third parties.

The Customer undertakes to reimburse any such amounts paid on their behalf, including any legal, postal and administrative expenses associated with the reimbursement request, and to indemnify the Rental Company against any damage and/or third-party claims.

Each administrative matter is subject to a handling fee, which the Customer hereby authorises the Rental Company to charge.

ONE-WAY RENTALS ARE NOT PERMITTED UNLESS SPECIFICALLY AUTHORISED BY THE RENTAL COMPANY.

  7. VEHICLE RETURN

At the start of the rental, the Customer must commit to a return date for the vehicle and/or motorcycle. Any change must be communicated to the Rental Company in advance.

A rental day consists of 24 hours, with a grace period of 59 minutes. Once this grace period has elapsed, an additional rental day will be charged.

For rates subject to specific time limits, such as weekend or weekly rates, exceeding the grace period will result in the entire rental being recalculated at the daily rate.

The vehicle and/or motorcycle must be returned in accordance with the Rental Company’s opening and/or closing arrangements. Out-of-hours returns are permitted only with prior authorisation. In such cases, the rental will be considered closed when the Rental Company next opens.

Failure to return the vehicle and/or motorcycle keys will result in the rental continuing until the keys are returned or a report of their loss or theft is presented.

Lost or stolen vehicle and/or motorcycle keys are subject to a compensation charge of €600.00, excluding VAT.

The Customer undertakes to return the vehicle and/or motorcycle in the same condition and with the same equipment as at the start of the rental, allowing for normal wear and tear.

If the vehicle’s and/or motorcycle’s original registration document is lost or stolen, the Customer shall pay a charge of €200.00, excluding VAT.

  8. ODOMETER

If the odometer fails, or if it is otherwise physically impossible to determine the distance travelled, a deemed mileage of 300 kilometres per day will be charged.

  9. GOVERNING LAW AND JURISDICTION

These Terms and Conditions are governed by Italian law.

Any dispute concerning the validity, interpretation, performance and/or termination of these Terms and Conditions shall fall within the jurisdiction of the court for the location where the Customer collected the Vehicle.
